Often when people are contemplating a divorce, they want to know if there is a possibility of obtaining a quick divorce. The divorce process in New Jersey is determined by how quickly the parties can reach a resolution. If the parties are able to reach an agreement and memorialize their terms in writing, the divorce process can go fairly quickly. If the parties are not able to reach a resolution and the court is required to intervene and make the necessary decisions, the process can take much longer.

How to speed up the divorce process 

In cases that are complex that have significant custody, parenting and financial issues, the divorce process can take considerably longer. When the parties do not have any children, property or debts to distribute, the issues to resolve are limited.

There are ways to work toward expediting the process. Consulting with legal counsel is the best way to familiarize yourself with the legal requirements that will be necessary to obtain a divorce. There are certain financial disclosures, which are required to obtain a divorce. Understanding those processes and obtaining the information to be provided can be time-consuming. Familiarizing yourself with what is required, and what needs to be obtained can be effective in working toward a quick divorce.  Exploring alternative methods of dispute resolution, such as mediation, arbitration, and the collaborative divorce process can also be effective and make a divorce go faster.

The simple uncontested divorce process in New Jersey

When there are limited issues or when there are not any issues that need to be resolved and the parties simply want a legal divorce, one party can file the necessary paperwork based on a claim of Irreconcilable Differences. Since New Jersey is a no-fault state, the parties can file for divorce based on Irreconcilable Differences provided that they meet the requisite six month waiting period.  

How to end a divorce quickly

There are effective ways to end your divorce matter quickly, but both parties have to be on the same page. Both parties have to be willing to make compromises. Both parties have to be willing to avoid personalizing the situation and being nasty toward one another. Once both parties come to an understanding that the purpose of the divorce process is to reach a common goal and realize that engaging in protracted litigation will not be helpful to anyone, especially when there are children, it is easier to keep matters on track.

Can you expedite a divorce

Prioritizing your goals and communicating in a productive way with your spouse, but also with the professionals involved in your matter will help to facilitate a quick divorce.  Consult with other professionals. Seek out a mental health professional, or a support group or family and friends that will allow you to express your frustrations about the process in a healthy, positive way. Avoid venting and fighting with your spouse. Avoiding toxic behaviors and unhealthy interactions will help to move the matter forward.
